In the practice of a patent attorney, it is important to cooperate with colleagues in other countries. Whereas European patent attorneys are generally most knowledgeable about the European and perhaps the national patent systems, it is necessary for them to have some knowledge of the practice in countries in which their clients also want to obtain patent protection. Further, overseas colleagues may have clients that want to obtain European patents, for which these overseas colleagues use European patent attorneys to act as a local patent agent.

Mexico has a new IP Law from November 5, 2020, the new Federal Law for the Protection of Industrial Property (FLPIP) details the kind of matter which is not susceptible to be patented which will help to resolve controversies that usually arise during the in-depth examination. Additionally, a Complementary Certificate has been included in the FLPIP, which could grant an extension of up to five years on the term of patents for cases in which the procedure for granting a patent exceeds 5 years from the filing date, if this is directly attributable to the Institute due to unreasonable delays. Although science and technology advance faster than the reforms to the legal framework, this new Mexican IP Law has been a huge improvement and it will give certainty and confidence to applicants and inventors who want to protect their inventions in Mexico.

Janett Lumbreras is a Senior Associate at Uhthoff, Gomez Vega & Uhthoff, S.C. with over 20 years of experience in patent matter, her practice areas are in Chemistry, Pharmacy, and Biotechnology.
She has a Pharmaceutical Chemistry-Biology Degree, from Universidad Nacional Autonoma de Mexico (UNAM), Mexico City, 1996, and has Diplomas in Access to Worldwide Scientific and Technological Information from Universidad Nacional Autonoma de México (UNAM); Industrial and Intellectual Property Law from Universidad Nacional Autonoma de México (UNAM); and Introduction to the UPOV System of Plant Variety Protection under the UPOV Convention from WIPO Worldwide Academy.
She is an active member of the Mexican Association for the Protection of Intellectual Property (AMPPI); the American Intellectual Property Law Association (AIPLA); National College of Pharmaceutical Chemists Biologists, Mexico, A.C. (CNQFBM, A.C.).

Dr. Manuel Lopez, is an associate at Uhthoff, Gomez-Vega & Uhthoff, with more than 16 years’ experience in intellectual property matters, including patent drafting and PPH filing, novelty and patent landscape searching, FTO & clearance searching, infringement and validity advices in the areas of Mechanical and Electrical Inventions.
He has particular expertise in Information Technology (IT), nowadays related to several industry fields, such as computer hardware, software, electronics, semiconductors, internet, telecom equipment, e-commerce, computer services, etc.
Manuel has a BSc (Physics), a MSc (Nuclear Physics) and a PhD (Electrical Engineering), from National Autonomous University of Mexico (UNAM). Before entering the patent profession, Manuel was a doctoral scientist in the field of Nuclear Physics. He is a member of the Mexican Association for Industrial Property Protection (AMPPI) and the American Intellectual Property Law Association (AIPLA).
