With the start of the UPC patentees will have the choice to litigate their European patents either before the UPC or before a national court. In this series of webinars the specifics of patent litigation before the national courts will be considered per country. In each webinar a specialist in the area of national and international litigation will highlight what procedural and substantial issues are specific for that country’s court proceedings and these will be put into relation with the proceedings that will be possible before the UPC. In that way a better choice can be made to either use the national court procedures or the UPC.
The Netherlands is one of the hot spots for patent litigation in Europe. The Dutch system for patent litigation is centralized at the courts of the Hague where specialist judges hear all patent cases. The Dutch courts have developed some approaches that are unique in Europe, such as a willingness to grant cross-border injunctions. Dutch judges also play a prominent role in the UPC, with Ms Rian Kalden presiding over the 2nd chamber of the Court of Appeals. There will be a Local Division in The Hague with two of the most experienced Dutch patent judges, Mr Edger Brinkman and Ms Margot Kokke. This webinar will discuss some of the peculiarities of Dutch patent litigation and explore the impact of the introduction of the UPC.
KOEN BIJVANK is a partner at Brinkhof in Amsterdam, the Netherlands. He is qualified both as an attorney at law (‘advocaat’) and as a Dutch and European patent attorney. He specializes in international patent litigation and oppositions before the European Patent Office. His practice mainly involves patents in the areas of life sciences and pharmaceuticals. Koen is the chair of the Standing Committee on Patents of AIPPI and co-founder and immediate past-president of EPLIT, an association of European patent litigators. He is also a member of the editorial board of the BIE, a leading Dutch journal on intellectual property, and a tutor at CEIPI in Strasbourg, France where he teaches candidates for the qualifying examination for European patent attorneys. Koen holds a master’s degree in organic chemistry of the University of Groningen, the Netherlands and a LLM and postgraduate certificate in intellectual property litigation of Nottingham Law School in the United Kingdom.
