Description
Many jurisdictions recognize a prior use right for defendants in patent infringement proceedings. A prior use right may allow use of a patent protected invention if the use of the invention has been taken up before the priority date of the patent. This webinar will provide an overview of the prior use rights in European jurisdictions. The scope of the prior use right, as well as strategies and pitfalls for successfully alleging this powerful defence in infringement proceedings will be discussed for the example of Germany. The webinar will conclude with an outlook on the expected handling of prior use rights before the UPC.
The webinar will be recorded and then only made available on our epi-learning platform to participants who have registered for the webinar.
